Am I able to make a claim?
Making a sexual abuse compensation claim with the criminal injury compensation authority has some requirements, generally, the time limit is either 2 years after the incident or 2 years after it has been reported. There can be special exceptions however if you were simply unable to report it due to fearing for your safety or too traumatised to do it. If the incident has been reported to the Police then you will have to make a claim no later than 2 years after reporting. If you have already made a claim regarding the incident you can’t make another claim.
Types of Sexual Abuse and Assault
Rape
Rape is forced penetrative sexual intercourse including vaginal, anal or oral penetration either by another person, persons or an object. Another way to describe rape is non-consenting intercourse. If the victim says no or is not in the position to be able to give consent, it is rape. Examples of such incidents are because of alcohol and drug influence or if the abused does not have the mental capacity to give consent due to disabilities. If a person is under the legal consenting age and gives consent it is still classed as child rape. Incest
Incest is sexual activity between family members or close relatives who have a consanguinity (blood relation) relationship. Consent does not play a part in incest being illegal.
Sexual Exploitation
Sexual exploitation is a term that covers different types of abuse. Sexual exploitation can describe child sexual abuse where the abuser coerces the child to perform a sex act on them or themselves. Exploitation can also be used to describe a person in a position of power exploiting another such as a teacher, doctor, police officer and so on.
Who am I claiming against?
Under the Criminal Injury Compensation Scheme 2012 a victim of sexual abuse may be able to make a sexual assault compensation claim against the Criminal Injury Compensation Scheme (CICS). This is a common route to take for those with abusers who have not been convicted or cases without concrete evidence.
